hiring Casual staff this Christmas?

AFTA@Work Newsletter article - Thursday 30th October, 2015

If you're looking to hire casual staff during the Christmas season, ensure you are aware of the applicable pay rates. LHD Lawyers share their expertise with Jeremy...

  • Q: I am the owner of a travel retail business which has a number of permanent full-time employees. As it is approaching the end of the year, I expect an increased workload. Consequently, I wish to employee a number of casual staff members to assist with the increased workload. What is the applicable pay rate for casual employees? Jeremy-Launceston

A: The relevant award is the General Retail Industry Award 2010. The relevant section is Clause 13. A casual employee must be paid at the ordinary hourly rate applicable to a full-time employee, plus an additional 25%.

Casual employees must be paid either at the end of each period of employment with your business, or on a weekly or fortnightly basis. The usual minimum daily engagement of a casual employee is three hours.

To avoid any pay disputes, you are advised to provide any casual employees with a written notice of the terms of their employment prior to them commencing employment with your business
