Q&A WITH LHD LAWYERS - STAFF ROSTERS

  • Q) I am the owner of a travel retail business. I am currently drafting rosters for some new full-time employees, and I was wondering what their ordinary hours of work should be. Can you please give me some advice? Samantha-Brisbane

A) The relevant award is the General Retail Industry Award 2010. ImageThe award states that workers may conduct their duties between 7:00am and 9:00pm Monday to Friday; 7:00am and 6:00pm Saturday; and 9:00am and 6:00pm Sunday. On any one day, an employee may be rostered to work up to nine hours with the exception that for one day per week they can work up to 11 hours.

A full-time employee will be rostered for an average of 38 hours per week. This may be reached by working 76 hours in two consecutive weeks; 114 hours in three consecutive weeks; or 152 hours in four consecutive weeks. However, you should note the National Employment Standards, which provide that an employer cannot require a full-time employee to work more than 38 hours per week unless the additional hours are reasonable.
